Waiver | TIDE JAMMERS LLC

Waiver and Release of Liability: YOU WILL BE REQUIRED TO SIGN THIS AT THE SITE LOCATION BEFORE ENGAGING IN ANY ACTIVITY it is your choice not to execute this waiver; however, we will not permit the use of our eqiptment to include but not limited to: kayaks, fishing poles, chairs, beach canopies, or any other equipment nor the use of any of our guides should you choose not to.

Assumption of Risk: I understand and accept that engaging in any of our outdoor services to include Surf Fishing, guided Eco Kayaking Tour, or renting a kayak for a self guided excursion, exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to drowning or bodily injury) and loss of or damage to property. I also understand I should be in good physical health to participate in fishing, and/or kayaking. I choose to participate in fishing/kayaking in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of obtaining a Surf Fishing Charter or renting a kayak and participating in fishing/kayaking. I understand the inherent risk involved in using a kayak, and fishing gear; I accept full responsibility for any and all such damage or injury which may result.

Waiver and Release: Tide Jammers LLC is already a limited liability company where I fully understand that I can't pursue any legal action against the owner(s) or employee(s) personal assets, or real property etc.,. Thus, I fully understand that by executing this liability waiver I will no longer have any ability to pursue any legal action against Tide Jammers LLC or their employees.

In consideration of Tide Jammers LLC renting me this kayak and/or taking me on a guided surf fishing excursion or guided kayaking eco tour or allowing me to use any beach canopies, chairs, or fishing equipment or other equipment owned by Tide Jammers LLC or their constituents; I specifically release and forever discharge Tide Jammers LLC and its officers, agents, and employees from any and all liability or claims for injury, (minor or great), illness, death or loss of or damage to property which I may suffer while renting any kayak, participating in kayaking or Fishing or the use of any of their equipment. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of myself or Tide Jammers or its officers, agents, or employees. It is my intent by the Waiver and Release Agreement to release Tide Jammers, LLC., and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Tide Jammers LLC, or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this kayak or participating in kayaking, I will have no right to make a claim or file a lawsuit against P&P or its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage. I understand that this waiver also bars any of my heirs, representatives, signers, or any other entity from seeking damages from any injury or death to myself.

I understand the basics of how to safely enter/exit and paddle a kayak. Initial: _____

I understand that when in doubt, I shall give other boaters right-of-way while i am Kayaking, and have been advised to stay to the sides of the bank out of the main channel, and will operate the rental kayak safely and in accordance with boating rules and regulations. Initial:. _____

I understand that a kayak does not have navigation lights and that I will not operate it when dusk or dark. Initial:______

I understand that should I engage in fishing that fishing equipment can be dangerous, and I accept this risk initial:______

I understand that upon return of any fishing equipment and/or any rented kayak Tide Jammers LLC will inspect it/them for damage. If unreasonable damage is discovered Tide Jammers LLC reserves the right to levee additional fee(s) on my final bill to cover any damages. Initial: _____

I agree that should legal action be pursued despite the fact I have executed this waiver knowing that I am freely waiving any and all liability against Tide Jammers LLC , or it's employees, and that I am barring anyone else from taking action on my behalf. I accept full responsibility of engaging in this activity all while completely understanding the risk involved in this activity; therefore, I further I agree that any legal action filed shall only occur in the judicial system located in Citrus County Florida: Initial_____
